Viabilidad y sostenibilidad económicas del planeamiento urbanístico: ¿dos requisitos o un cambio de enfoque?

Abstract

La sostenibilidad económica del planeamiento urbanístico, incorporada por la Ley de Suelo (2007), y la redefinición de la viabilidad económica por la Ley de Rehabilitación, Regeneración y Renovación Urbanas (2013), obligan a reformular las condiciones y objetivos de la acción urbanística. Los autores sostienen que la clásica viabilidad económica, no es sino insostenibilidad y una barrera para la actuación sobre la ciudad existente. En consecuencia, las exigencias del Informe sobre Sostenibilidad Económica (ISE) y de la Memoria Económica de las actuaciones sobre el Medio Urbano (MEaMU) suponen un cambio de paradigma que, aunque todavía inaceptado y requerido de adaptación por las CC.AA., a la vista de la STC 143/2017, es necesario para el presente y futuro de la acción urbanística. ---------- ABSTRACT---------- The economic sustainability of urban planning, incorporated by the Land Law (2007), and the redefinition of economic viability by the Urban Rehabilitation, Regeneration and Renewal Law (2013), requires reformulating the conditions and objectives of the urban action. The authors argue that the classic economic viability is nothing but unsustainability and a barrier to urban intervention on the existing city. Consequently, the requirements of the Economic Sustainability Report (ISE) and the new Economic Report of Viability in the existing city interventions (MEaMU) represent a paradigm shift that, although still unaccepted and to be adapted by the Regional Governments considering the Constitutional Court Sentence STC 143/2017, is necessary for the present and future of the urban action.
