Abstract

Biotechnology is a growing field in science all around the world. It has the potential to solve many of the problems that affect humanity currently, such as world hunger, climate change and health issues, but also it can have profound changes in technological, social and economic development. However, in order to do that, new biotechnological products and methods have to be created. These need to be protected in order to exploit them and to reserve its rights to the patent holders. Therefore, patents play a crucial role in the innovation and the development of biotechnology. In this project, Spanish innovation in the field of biotechnology will be assessed through an analysis of its patents and will be compared to the European situation. Regarding the regulation of biotechnology patents, in Spain a new law was adopted in 2015 to match the European regulation and to regulate many specific aspects about patenting in biotechnology. Thanks to this change and update, both the Spanish and the European legal system do not represent and obstacle to patenting in biotechnology. Nevertheless, there is still a long way to go to catch up with some of the other European countries. Within the analysis of the patents and the innovation in biotechnology, there are two areas which have to be taken into consideration: private companies and public organisations. After examining both of these areas and different aspects related to them like the funds invested, economic impact or problems that public organisations face when patenting, several conclusions are reached. It is clear that Spanish biotechnology needs to receive more funds in order to be able to do research and develop new products and technologies that could be patented. The lack of funds is definitely the main problem and it also affects both the private and the public sectors. Also, there are other challenges that biotechnology and its patents have to face in order to success in companies, universities and research centres, such as a very small percentage in technology transfer or a lack of competitive science. These and some possible solutions to them will be explained during the project. In conclusion, biotechnology is one the fields which is experimenting the biggest growth in patent application in Spain and Europe. Unfortunately, the Spanish biotechnology patent field still has to overcome certain challenges in order to be considered competitive.
